Saratoga Race Course ready to get back to normal

SARATOGA SPRINGS, N.Y. (AP) — Like just about everybody else around here, Jack Knowlton is stoked for opening day at Saratoga Race Course.

“It’s been a long time without being able to be at Saratoga with tens of thousands of people there, so we’re really excited,” Knowlton, operating manager of Sackatoga Stable, said Wednesday. “The town has been buzzing for the last month. It’s incredible the kind of pent-up demand that there is.”

A year after racing was conducted at Saratoga without fans due to the coronavirus pandemic, the New York Racing Association’s summer meet at the oldest racetrack in the country begins Thursday, and full-capacity admission is allowed again for the 40-day meet. That means the venerable track, which opened during the Civil War in 1863, has a shot at attracting paid attendance of over a million again after its five-year streak was broken.

“We’re absolutely thrilled to be able to welcome fans back … following a year in which we had no spectators and these races were run in front of empty grandstands,” NYRA communications director Patrick McKenna said. “There is a different kind of energy and enthusiasm around the opening of this meet. I think you can feel it in the air. It really signaled that we have turned the page on COVID here in New York by virtue of the fact that more than 70% of adults are now vaccinated.

Following the four-day opening weekend, racing will be conducted Wednesday through Sunday, with Mondays and Tuesdays dark until the finale on Labor Day.

The stakes schedule features 76 races worth $21.5 million in total purses. Highlights of the meet include the 152nd running of the $1.25 million Travers Stakes on Aug. 28 and three weeks before that the $1 million Whitney Stakes, which offers an automatic berth to the Breeders’ Cup Classic in November at Del Mar. The meet also will include the $1 million Jockey Club Gold Cup and the $600,000 Flower Bowl, both previously run during the fall meet at Belmont Park.

Just the thought of that left Kika Barbariantz all smiles as she tidied up Bob & Adam Coglianese’s photo booth behind the grandstands on Wednesday. It’s been a long year.

“It feels great to be back. Last year was depressing,” said Barbariantz, a Bronx native who’s been coming to Saratoga since she was 11 years old and once was a hot walker for late Hall of Fame trainer Woody Stephens. “It’s nice to see familiar faces. Just to be at the racetrack, it’s incredible. I just missed being here. I knew this year was going to be special. It’s nice to see cars. It’s crowded. There’s a lot of traffic.”

Two years ago, the Saratoga meet set a record for all-sources betting handle at over $705 million, even though weather knocked out a full day of racing and half of another. Last year reflected the track’s allure — total handle was $702.5 million with an average daily handle of $17.5 million.

“What we think 2020 showed was that bettors respond to excellent, interesting and dynamic racing,” McKenna said. “To eclipse $700 million in handle for the second straight year in the absence of fans was important because what that money does is support horsemen, the small businesses that they’re running by and large. That was why it was important to come to Saratoga.”

It’s important for Hall of Fame trainer Bob Baffert, who in May was barred by NYRA from racing at Saratoga, Belmont Park and Aqueduct after his Kentucky Derby winner Medina Spirit failed a postrace drug test. A New York federal judge on Wednesday nullified Baffert’s suspension, finding that NYRA acted unconstitutionally by failing to let him adequately respond to claims made against him.

NYRA president and CEO Dave O’Rourke said in a statement the organization was reviewing the court’s decision to determine its legal options.

“Mr. Baffert’s actions and behavior can either elevate or damage the sport,” O’Rourke said. “We expect Mr. Baffert to exert appropriate controls over his operation.”

Constitutional Court judges reject recusal bid in Malaba hearing

HARARE – Zimbabwe’s Constitutional Court judges on Wednesday refused to recuse themselves in an urgent matter that will decide the fate of the embattled Chief Justice Luke Malaba – and their own retirement age.

A Zanu PF activist Marx Mupungu is challenging a ruling of the High Court that Malaba ceased to be a judge and Chief Justice when he turned 70 in May, and that a constitutional amendment rushed through parliament giving President Emmerson Mnangagwa sweeping new powers to extend the terms of superior court judges for a maximum five years past retirement age could not benefit incumbent judges.

Human Rights NGO Forum executive director Musa Kika had lodged an application for the recusal of the judges – who were all cited as respondents in the High Court case – arguing that they are conflicted and could not be judges in their own cause.

The application was dismissed by a Constitutional Court bench chaired by Deputy Chief Justice Elizabeth Gwaunza after several hours of arguments. The ruling cleared the way for the Mupungu application to be heard on its merits on Friday.

The court did not give reasons, but lawyers said it had created a “constitutional crisis.”

Lawyer Thompson Chengeta, who followed the televised proceedings, said: “The judges kept saying ‘you want an entire bench to be recused, yet there’s no existing law to allow for the appointment of acting judges, can’t you see what you are requesting is impractical?’

“If followed to its illogical conclusion, the reasoning of the Constitutional Court judges is that because there’s no laid down law or procedure for their replacement if they recuse themselves, then they should be allowed to sit in a matter where they have interests. That’s the definition of a constitutional crisis.”

In his application, Kika argued that the High Court ruling handed down on May 15, 2021, by a three-judge panel affected the same judges who are set to make a determination on Mupungu’s application at the Constitutional Court.

Kika argued: “This is an application made in terms of section 85(1) of the Constitution of Zimbabwe for the recusal of the cited honourable judges being second to 17th respondents and of Luke Malaba (the first respondent), in the event that he is found to still be the Chief Justice of Zimbabwe, from hearing the matter under case number CCZ13/21 as that would infringe the applicant’s right to a fair hearing as provided by section 69 of the Constitution of Zimbabwe.”

Zimbabwe’s judiciary was plunged into crisis by the May ruling by Justices Happias Zhou, Edith Mushore and Jester Charewa.

The three judges ruled that a constitutional amendment could not benefit an incumbent public official, and President Emmerson Mnangagwa’s move to extend Malaba’s term past retirement age was invalid.

The High Court ruling also has a bearing on the other 17 judges, who were cited as respondents, as they also stand to benefit by having their terms extended past the retirement age of 70.

The Judicial Service Commission and the Justice Minister appealed the ruling at the Supreme Court. Malaba returned to office, arguing that the appeals suspended the High Court order.

Before the Supreme Court could hear the matter, Mupungu – through Madhuku – approached the Constitutional Court challenging the High Court ruling.

Mupungu argues that there should be no doubt among citizens as to who the Chief Justice is at any one time, and where some doubt is cast by a lower court, as is the case now, the Constitutional Court, on application, must swiftly put finality to issues being raised.

He also argues that Mnangagwa’s conduct was constitutionally valid and that his application is of extreme urgency as the issues raised are of immense public importance requiring an authoritative determination by the highest court.

Structural Repair of Pool Deck in 1996 at Center of Surfside Building Investigation

Newly discovered documents from 1996 have shed a light on the pool deck at the center of the recent building collapse in Surfside, Florida. According to the 25-year-old construction permit, the structural integrity of the deck slab at the Champlain Towers South Condo has been an issue for quite some time.

As reported in the Miami Herald, the documents, which were submitted to the Surfside Building Department, show that the pool deck needed 50 feet of cracks to be sealed up and a replacement for a 20-square-foot slab. These repairs were later certified by consulting engineer Tong Le in a letter from November 1997. In all, the work cost $156,602.

That this came only 15 years after construction of the building had been finished further indicates the relatively poor shape that the structure had apparently been in from the start. A structural engineering expert speaking to the Herald called the need for such extensive repairs after such a short period of time “atypical.”

The pool deck in question has come under particular scrutiny from investigators following the collapse of the Champlain Towers South Condo on June 24. The deck slab had also served as the ceiling for an underground parking garage. A video acquired by investigators showed that ceiling falling apart not long before the rest of the 12-story building went down.

Another report from 2018, conducted by engineer Frank Mirabito, concluded that the original design of the building, particularly around the pool deck and a nearby set of planters, had resulted in “major structural damage” to the deck slab over time. He also noted that the 1996 repairs detailed in the above-mentioned report were “insufficient” in addressing the slab’s problems.

The Surfside building collapse has cast a harsh spotlight on the systemic issues inherent in buildings in and around the greater Miami area. Almost 100 bodies had been found in the Champlain Towers wreckage as of Monday and many of the building’s residents remain unaccounted for. Approximately 18 million pounds of rubble have been excavated from the site, as of Tuesday.

While investigators have homed in on certain factors, including the pool deck slab, it remains unknown what precisely caused the condo to collapse when it did. Officials say a full investigation could take weeks or months to complete.

“They have given of their heart and soul,” Miami-Dade County Mayor Daniella Levine Cava said at a recent news conference, in reference to the many responders to the disaster. “We are totally walking among superheroes.”

On December 7, in the Kiev restaurant-club Harry, the premium salon Kika-style gathered friends to celebrate its 20th anniversary. Irina Danilevskaya, Aleksandra Oleinik, Irina Turbaevskaya and Olga Oleksenko came to congratulate the masters and brand director Ruslana Moroz.

Over the years of its existence, Kika-style has turned into a whole empire of beauty. And it all started with an interesting case, a little over 20 years ago, which prompted Ruslana to start her own business.”If my neighbor hadn’t dreamed of being a blonde, I wouldn’t have become a stylist.” In the place where the neighbor Moroz dyed her hair, they recruited models for the hairdressing school. She got a haircut that made her fall in love with the profession. A year later Ruslana already studied at the same school.

In the 1990s, Ruslana’s career began to develop rapidly. After only two years from the start of work as a stylist, she was asked to head one of the salons. This position made it possible to understand that she had enough strength and confidence to do something of her own.“Involving specialists in the work, I felt that now I am responsible for someone. It was then that the idea came to create your own beauty salon, ”says Ruslana.

Today it is impossible to doubt the premium quality of Kika-style. The brand was named among the 37 best salons in the world (Red Book, White Book Estetica Design Award 09). Films about the past are an attempt to escape from the terrible present, says Todd Haynes.Festival laureate and Oscar nominee, made his name for The Velvet Goldmine, I’m Not There, Carol, and now has made his first documentary, The Velvet Underground for Apple. After the premiere of the film at the Cannes Film Festival, the director shared his secrets with Izvestia.

– You seem to be obsessed with music: a significant part of your creativity is devoted to it.

Some people like ice cream.I am music. And this is from early childhood. Music flows through our arteries, with its help we memorize personal stories, it seems to mark the time for us. Even songs and artists you don’t like too much serve this function.

When after a while you hear the same song again – it is like a time capsule, ideal in its effect. It instantly moves you to that very moment. Music links time and personal stories.

But I was also always interested in the ways of storytelling. How different genres and biographies are portrayed in films. What place does this kind of cinema take in our culture? These thoughts occupied me when I made films about Karen Carpenter, David Bowie and Bob Dylan, and this time too was no exception. By the way, I’m currently working on a painting about Peggy Lee. But when I was told that there was an opportunity to make a documentary about The Velvet Underground, I did not hesitate for a second.

– What time capsule is this group launching for you?

Perhaps the beginning of my college education. The coolest thing about them was that you understood that no one could ever write such a thing.

– Your film focuses on Lou Reed’s relationship with guitarist John Cale. You focus on this combination of love and hate even more than Andy Warhol. What was it like trying to figure it out, given that people have died a long time ago?

I would start by saying that making this film without Lou Reed’s input was the biggest creative and structural challenge. Of course, we used his archival interviews to make the viewer hear his voice. Photos, chronicles and films with his participation, so that you can see him. In addition, he comes to life in the memories of those who were able to talk about it on camera. And all the same – he was not in our studio. And each time during editing, the question arose: how to make the viewer feel it?

I showed this film to Lou Reed’s fans and they were of course mad that we paid too much attention to John Cale.You won’t please everyone, what can I say. But in this way we restored historical justice by celebrating the creative contributions of all members of the group. And so we added another facet of Lou Reed to the film. To show that he was both there, and at the same time, as it were, was absent, we see him in the frame not often, only for the finale we give a few pieces with him and Andy Warhol. And again we show Cale.

Yes, their relationship is the core of the film. First it is love and co-creation, then something more complicated: division of territory, conflicts, parting.But all this supported the fire in creativity. This relationship was gone – the group soon disappeared.

– In your previous films about musicians, artistic images and poetics came to the fore. How did you find the balance between poetry, psychology and storytelling in this tape?

Thank you, very nice to hear! Yes, most films convey facts to the viewer, reveal the truth, shed light. Only this “truth” is different in different pictures. We had a trump card – we had great avant-garde cinema at our disposal, which was made where the band The Velvet Underground was doing.Rather, it was all part of a single whole.

To some extent , it was the films that gave birth to The Velvet Underground, and the group, in turn, became another symbol of blurring the boundaries between the arts . But at the same time, it is clear that few people watch those magnificent tapes of Andy Warhol, Kenneth Anger and Jonas Mekas. So we also made the film immersed in amazing cinematography – this defined its visual language.

Yes, we had fantastic interviews that we recorded. But I wanted the viewer to be guided by musical and film images, not words. Most of the time I used a split-screen, a simple diptych like Andy Warhol in Chelsea Girls. And in his shows, he often combined several images, for a while it became fashionable. The Woodstock Oscar winner is all split-screen. Then this form somehow disappeared and, probably, in vain, it seems to me very expressive, concealing in itself many interesting and unobvious dramatic tricks.

– The film also contains a political message related to the beliefs of the characters. How would you define it?

I would say that their political views are anti-political. In an era of protests, antiwar demonstrations, and civil rights struggles, New York’s cultural elite was demonstratively indifferent to political rhetoric. But there was still politics here. Just different. I would call it Freudian identity politics, an understanding of what is happening in the artist’s soul.

The film shows how the rather dark images of The Velvet Underground contrasted with the hippie movement – sun, flowers and love instead of war. They frightened people at first. But then it became clear that it was precisely this position that emphasized the fragility and vulnerability of the individual in a society that alienated her . This approach seems important and powerful to me. The members of the group were not intellectuals, did not read Baudelaire, did not know what decadence and avant-garde were. But emotionally they experienced it all – and generously shared it with the whole world.

– How would you describe Lou Reed and Andy Warhol’s relationship? There was also a conflict, apparently.

– I think the relationship has undergone significant changes over time. There is a quote from Lou Reed in the film, where he honestly says that if it were not for Andy Warhol, the group would not exist.Andy was the producer of , he called Niko there. He made the band become an event for New York. He protected and helped them. But all of this is true to some extent. Because Warhol didn’t make music, they, these guys, made it. And his authority, of course, could not but weigh them down at all.

But this conflict is still much weaker than that of Reed and Cale. Reed always wanted to be a classic rock star, and he was unable to do so within the band. Therefore, he made sacrifices, starting with the expulsion of Cale and gradually destroying the group.On the last disc you can feel it very much.

– One of the brightest characters in your interviews is Jonathan Richman, who became a musician thanks to The Velvet Underground. He seems to be speaking on behalf of all the fans – and at the same time visually analyzing the band’s riffs.

We had big problems with video archives of performances. And Richman literally saved us, because he was personally acquainted with all the members of the group, they taught him to play the guitar, and he, like no one else, could explain why they were great artists of , what kind of people they were, what their cultural significance is.And he was there, he lived with them, he was at their concerts 80 times, he is like their mascot.

And he is also a symbol of the incredible nobility and patience of the guys from The Velvet Underground in relation to a somewhat obsessive teenager. His interviews are very touching, because they are filled with gratitude, openness, love. And his guitar is an independent hero of the film.

– All your films are about the twentieth century, even “Dark Waters” starts at that time.Why are you not interested in XXI?

Just look around! I guess I have been seeking refuge in the past. It became really relevant with covid, I saved myself by watching old films avidly. Recent years have generally been a serious test. First Trump, then the coronavirus. We seriously wondered if we are in control of anything on this planet. What to do with this eerie heat, a clear consequence of global warming? Times are absolutely crazy now.

And I’m looking somewhere in the past for answers to questions about the structure of society, values, creative tasks, cultural life — today they are somehow not very well represented in pop culture. Well, yes, maybe because of this I am missing something important, maybe even the most important, I am ready to admit it. But for me this is a way to somehow break through and survive.
