Dental specialist centre washed, reused tips, says witness | Malaysia

KUALA LUMPUR, Oct 10 — A former employee of Imperial Dental Specialist Centre told the Sessions Court here that the centre did not dispose of any of the needle tips used in dental treatment as they were washed for reuse instead.

Former dental surgery assistant, Noor Azima Mohd Nuwi, 26, said the cleaned tips would be kept in a bottle.

“The tips are used to flush patient’s teeth or gum. They are connected to a syringe,” she said during examination-in-chief by deputy public prosecutor Nadia Zulkefli in the trial in which the clinic is facing nine charges relating to the death of Datuk Syed Alman Zain Syed Alwi while being treated at the premises last year.

The 10th prosecution witness was responsible for assisting the doctor in the surgery room, including in preparing the necessary equipment for the surgery.

When asked by judge Harmi Thamri Mohamed @ Shaharuddin whether reusing the tips had been a practice at the dental centre, Noor Azima said: “During the time that I worked there (at Imperial), the bottle is indeed being used to keep the tips. The tips will always be reused after being washed.”

Earlier, the witness said that she and her colleagues were given training to identify all emergency equipment at the centre after the death of Syed Alman Zain.

She said it was the first training she had ever received while working at the clinic and that it was conducted by Datin Dr Wong Yen Ling, or also known as Dr Alice.

When asked the date of the training, the witness said she was unsure, but it was a few days after the death of Syed Alman Zain.

On Aug 12 last year, the company represented by company director Dr Wong claimed trial to nine charges in connection with Syed Alman Zain’s death.

Dr Wong, as licence holder, was charged with, among others, failing to ensure that Dr Ting Teck Chin, who administered anaesthesia to Syed Alman Zain, had the qualification to do so.

The centre is also accused of failing to ensure that the individuals it engaged to perform orthopantomogram, anaesthesia and IV sedation on Syed Alman Zain had the necessary qualifications.

It is also accused of failing to put in place, life-saving measures by not providing oxygen as a basic emergency care service as well as failing to submit to Universiti Malaya Medical Centre, a copy of all of Syed Alman Zain’s medical records when he was transferred there.

The centre is also charged with failing to keep and maintain a staff register record, adhere to medicine labelling regulations and take adequate measures to protect its professional healthcare and environment staff from biological hazards.

The offences were allegedly committed at the dental specialist centre at Jalan Telawi, Bangsar Baru, Brickfields here between 6pm and 9.05pm, between May 26 and June 2, 2016.

Seven of the charges are under Section 31(4), 39(2), 40(4) and 117(2)(b)(i) of the Private Healthcare Facilities and Services Act 1998, which provides for a fine of between RM30,000 and RM300,000, upon conviction.

The other two charges are under Regulation 49(7) and 245(6) of the Private Healthcare Facilities and Services (Private Hospitals and Other Private Healthcare Facilities) Regulations 2006, which carry a fine of up to RM10,000 or three months’ imprisonment or both, on conviction.

Lawyer P. Sreekant represented Dr Wong on behalf of the dental centre.

Dental specialist centre fined RM320,000 over death of Zahid’s son-in-law

KUALA LUMPUR: A dental specialist centre, Imperial Dental Specialist Centre Sdn Bhd, was fined RM320,000 by the sessions court here today after it was found guilty on five counts for causing the death of former deputy prime minister Datuk Seri Dr Ahmad Zahid Hamidi’s son-in-law, Datuk Syed Alman Zain Syed Alwi, during a dental treatment there.

Judge Harmi Thamri Mohamad @ Shaharuddin made the ruling against the centre, which was represented by a member of its board of directors, Dr. Alice Wong Yen Lin , 47, as the person summoned, after finding the defence having failed to raise reasonable doubts in the case.

“The court takes into account factors that are consistent with the provisions of the law to be a lesson and an example for all medical practitioners to comply with the Malaysian Health Ministry’s standards,“ he said before handing down the sentence.

The court allowed the dental centre to pay the fine in stages, with RM25,000 to be made today, and the balance of RM295,000 from Jan 21 to Jun 28 next year.

Dr Wong was also ordered to pay prosecution cost of RM5,000.

The specialist dental centre was initially charged with nine counts pertaining to Syed Alman Zain’s death but was ordered to enter defence into five of the charges.

They were for the second, third, sixth, seventh and eighth charges, while the centre was acquitted and discharged of the first, fourth, fifth and ninth charges on grounds that the prosecution failed to prove a prima facie case.

On the second and third count, the centre, as a licence holder, was alleged to have failed to ensure that Noor Azima Muhamad Nuwi, 26, was qualified to conduct an orthopantomogram on Syed Alman Zain and also with failing to keep and maintain an ‘Employee’s Register’.

On the sixth count, the centre was charged with failing to provide the necessary measures to save Syed Alman Zain’s life, namely by not providing oxygen.

For the seventh count, the centre was charged with failing to submit to the University Malaya Medical Centre (UMMC) – which received the patient under emergency transfer – a copy of all the patient’s medical records required under Section 31 (1) (d) of the Private Healthcare Facilities and Services Act 1998.

While for the eighth count, the centre was charged with failing to take adequate steps to protect healthcare professionals and the clinic’s environment against biological hazards, as required under Rule 49 (5) of the Private Healthcare Facilities & Services (Private Hospitals and Other Private Healthcare Facilities) Regulations 2006.

The centre was acquitted of four counts pertaining to the administering of anaesthesia and drug labelling.

Dr. Firdaus Hanapiah graduated from the University of Otago, New Zealand in 1990. Upon graduation, he returned to Malaysia to take up a position as a clinical tutor at the Department of Oral and Maxillofacial Surgery, Faculty of Dentistry, University of Malaya. In 1993, he joined the Eastman Dental Hospital, University College in London where he was a part time honorary Senior House Officer. In 1996 he completed an MSc in Oral Surgery from the Eastman DC and was awarded a Fellowship in Dental Surgery of the Royal College of Surgeons, England. He once again returned to Malaysia to take up a position as a lecturer at the Department of Oral and Maxillofacial Surgery, Faculty of Dentistry, University of Malaya. In that time, he was awarded the Fellowship of the International Congress of Implantologist and became a member of The International Team for Implantology (ITI). He is now in private practice based in the DEMC Specialist Hospital, in Shah Alam, Selangor, Malaysia, acting as a consultant Oral & Maxillofacial Surgeon. He is also Head Clinician for the Firdaus and Sharina Dental Clinics, Bangsar Dental Specialist Centre, Consultant OMFS Surgeon for the Smile Clinic Group and the Glamsmile Dental Specialist Centre in the Klang valley. Additionally, he is a registered Specialist in the National Specialist Register of Malaysia (NSR) and a member of the the Academy of Medicine of Malaysia. He has since placed more than 6000 dental implants and is a pioneer in the field of virtual surgical placement of implants. Dr. Hanapiah is actively engaged in global conferences, and has lectured widely in both Europe and Asia.

Dr Kenneth Lew graduated with a Bachelor of Dental Surgery in 1982 with numerous University Medals . He then studied orthodontics in University of Adelaide with the late Profe sor Milton Sims, under a NUS Scholarship from 1984 to 1987. After graduating with a MDS Orthodontics in 1988, he served as an academic in NUS Dental Faculty and a Clinician in NUH. In 1992, the Royal College ofSurgeons of Edinburgh bestowed Dr Kenneth Lew with a fellowship, without any examination, in acknowledgement of his vast contribution to Dentistry. A Fellow of Academy of Medicine on both general and specialist roles, Dr Lew has served as external examiners to both BDS and MDS Orthodontics program regionally Dr Lew has authored over 60 articles published in international referred journals and invited to speak at more than 300 conferences worldwide.

 

Dr Lew is citied in ” International Who’s Who of Professional ” as a dental expert in Orthodontics and Esthetic Denti stry who is the secret behind the smile of many Asian celluloid personalities. Dr. Anand Marya is a Ph.D. researcher at Thammasat University, Thailand. He is an active member of associations such as the International Association of Orthodontics  (IAO) , the International Association of Orthodontists and Implantologists (IAOI) and the, American Dental Association (ADA). He completed his Post  Graduate diploma in Hospital and Health Care Management from Symbiosis Center for Health care, Pune. He is the only graduate from his school to be awarded a research grant by the Dept . of Science and Technology , and the National Center for Research, Philippines to study stresses on maxillary expansion using the finite element method. He has been actively involved in research problems related to maxillary expansion needs and modalities, extraction vs non extraction techniques and profile correction problems. In addition to this, he has scientific papers published in the fields of Orthodontics and Forensic Odontology in various international and national journals . He has also authored various eBooks to help promote dental awareness and a member of the editorial board for various scientific dental journals.

Dr. Ng Choon Yau obtained a Bachelor of Dental Science from the University of Melbourne after his first degree from the National Yang Ming University (Taiwan). He also graduated from the Basic Comprehensive Orthodontic Program conducted in Singapore and personally mentored by Dr Kenneth Lew. Being a general dental practitioner,  Dr Ng is a firm believer in continuing education. He is an accredited user of Invisalign, Damon Orthodontic and Simpliclear . He has involved extensively in Dr Kenneth Lew’s orthodontic training program in Singapore, Malaysia and Hong Kong. Dr Ng is a testimony of how a GP can successfully incorporate Orthodontics in a GP practice.
